A three-judge panel of the US Court of International Trade ruled 2-1 on Thursday that President Trump's 10% global tariffs, imposed under Section 122 of the Trade Act of 1974 in February, are unlawful. The court found the administration failed to demonstrate a qualifying balance-of-payments deficit as required by the statute. The ruling was brought by small businesses represented by the Liberty Justice Center, though the tariffs are expected to remain in effect during an appeal already filed by the Trump administration.
